These Terms of Service ("Terms") govern your access to and use of the Einston platform, websites, and related services (the "Service") provided by 128bit labs ("Einston", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement to terms

By creating an account, booking a demo, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms, and that you have the authority to bind the organization you represent.

2. Use of the Service

Einston grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes, subject to these Terms and any order or subscription agreement between us.

3. Accounts and eligibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use. You must be at least 18 years old and able to form a binding contract to use the Service.

4. Acceptable use

You agree not to:

• use the Service in violation of any applicable law or regulation;
• reverse engineer, copy, or create derivative works of the Service except as permitted by law;
• interfere with or disrupt the integrity or performance of the Service;
• upload content that infringes the rights of others or contains malicious code.

5. Customer content and data

You retain all rights to the training materials, recordings, and data you submit to the Service ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy.

6. Intellectual property

The Service, including its software, design, and trademarks, is and remains the exclusive property of Einston and its licensors. No rights are granted to you other than as expressly set out in these Terms.

7. Subscriptions and payment

Paid features are billed according to the plan or order you select. Fees are non-refundable except as required by law or expressly stated in your order. We may change pricing on renewal with reasonable prior notice.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Einston will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

10. Termination

We may suspend or terminate your access to the Service if you breach these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use after the changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which 128bit labs is established, without regard to its conflict of laws rules.
